Hello friends and neighbors – there’s a lot going on Superior these days. I’ve seen some helpful threads on Facebook and have received many messages from residents wanting more details. Land Rover owns the land (which is zoned to allow for a car dealership) and has leased it to a used car dealership. As a private landowner, Land Rover can do whatever they want with land they own provided it is consistent with the existing zoning on the land. The land was zoned back in the 1990s when Rock Creek was developed. I have seen some people ask why the Town can’t review/change the zoning on the parcel. That’s a good question. However, zoning is a property right and a local government can’t unilaterally change the zoning on a particular property without the consent of the property owner (which we do not have from Land Rover). That could constitute an unconstitutional “taking” and would be similar to the Town condemning the property through eminent domain. While certainly possible, it would be costly and would result in litigation. This doesn’t mean that the Town can’t do anything about the zoning in this location or that it will always be a car dealership, but a change would definitely be difficult without the property’s owner consent.
I checked with Town Staff on Friday and according to them Comcast has not yet “flipped the switch” on the crossover to the new fiber optic network. My understanding is that they are still testing the newly installed fiber, but we have not yet experienced the new fiber service. I’ve also reached out to the Town’s Comcast project person for additional information to confirm and have asked if there are any additional upgrades that we should be aware of to be able to take advantage of the new services. I’ll report back when I learn more. Just an FYI – this was not a Town project. This was a Comcast upgrade that is allowed to happen without Town approval because Comcast has rights to access the utility easements to service their existing cable network.
The McCaslin work has been planned in our Town’s Capital Improvement plan for a number of years. The roadway subsurface was failing, as was the membrane underneath the roadway on the bridge over Coal Creek. Paving on McCaslin is scheduled for next Wednesday thru Friday. Traffic will be switched to the inside lanes on Wednesday and to the outside lanes on Thursday and Friday. Striping will occur on Monday Oct. 8. The bike lanes/sidewalks on the West side of McCaslin were a much needed addition to that street and will provide increased safety for our residents. I certainly appreciate that it is an inconvenience to all of us. We’re almost done. Thanks for your patience.
Demolition work has begun at the former Sports Authority. The building is being divided into two separate spaces, one for a Goldfish Swim School and the other for a Stickley & Audi Furniture Store.
Work on the new Skate Park in Autrey Park (by the dog park) is scheduled to begin the week of October 8, with an expected completion in December (weather permitting).
